General Terms and Conditions

§ 1 Scope

These General Terms and Conditions apply to all orders placed by consumers through our online shop. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code).

§ 2 Contracting party and conclusion of contract

The purchase contract is concluded with Magnic Innovations GmbH & Co. KG, Lohkamp 5, 33829 Borgholzhausen, commercial register HRA 6759, Local Court of Gütersloh.

The presentation of products in the shop is not a binding offer. By submitting your order, you make a binding offer. We confirm receipt automatically; this confirmation of receipt does not yet constitute acceptance. Acceptance takes place through an express order confirmation or shipment of the goods.

§ 3 Prices, shipping and payment

Prices displayed in the shop include statutory VAT where applicable. Shipping costs and any other costs are shown separately during checkout before the order is completed.

The available payment methods are shown at checkout. If advance payment by bank transfer is selected, a discount of 3% on the goods is applied where shown during checkout. Payment is due in accordance with the payment information provided during checkout.

Deliveries outside the European Union may be subject to import taxes, customs duties or similar charges. These are borne by the recipient unless expressly agreed otherwise.

§ 4 Delivery

Delivery times and restrictions are stated in the respective product description and during checkout. Unless otherwise stated, goods are shipped after receipt of payment. Partial deliveries are permitted where reasonable for you.

§ 5 Retention of title

The goods remain our property until payment has been made in full.

§ 6 Warranty

The statutory rights concerning defects apply.

§ 7 Right of withdrawal

Consumers have the statutory right of withdrawal. Details are provided in our withdrawal information.

§ 8 Contract language and applicable law

The contract language is German. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this applies only insofar as it does not deprive them of mandatory consumer protection provisions of the country in which they have their habitual residence.

§ 9 Place of jurisdiction

If the customer is a merchant, a legal entity under public law or a special fund under public law, our registered office is the place of jurisdiction for all disputes arising from contractual relationships.
